Welcome to SmartyPlants Ltd (“SmartyPlants”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your purchase of our products and use of our app and related services (collectively, the “Services”). By purchasing our products or using our Services, you agree to these Terms.

These Terms should be read together with our Terms of Service and Privacy Policy.



1. Products and Orders

 

  • Description: We make every effort to describe our products accurately, but minor variations or errors may occur.
  • Pricing: All prices are shown in GBP (£) and may change without notice.
  • Orders: An order is confirmed when you receive an order confirmation email from us.
  • Delivery: Delivery times are estimates and not guaranteed. We are not liable for courier or customs delays.
  • Risk and Ownership: Risk passes to you upon delivery; ownership transfers once full payment is received.

 


 

2. Returns and Refunds

 

You may return a product within 30 days of receipt if it is not as described.

Returned items must be in their original condition and packaging. Refunds are issued to the original payment method once inspected.

To initiate a return, contact support@smartyplants.ai.

This does not affect your statutory rights under the UK Consumer Rights Act 2015.

 


 

3. Warranty

 

What’s Covered:
Your SmartyPlants product is protected against manufacturing defects for 24 months from the date of purchase, as long as it has been subjected to normal use. 

What’s Not Covered:
Accidental drops, misuse, tampering, general wear and tear, or any unauthorized repairs.

How We’ll Help:
If we confirm a manufacturing fault during the warranty period, we’ll repair, replace, or refund your product. 

How to Claim:
Email us at support@smartyplants.ai with:

  • Your proof of purchase
  • A quick note describing the issue

Please hang onto your hardware until we guide you on next steps.

 


 

4. App Access and Use

 

  • The standard SmartyPlants App is provided free of charge.
  • An account is required to access the app features.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree not to:
    • Reverse engineer, copy, or resell the App or its content.
    • Use the App for unlawful or harmful purposes.
    • Interfere with or disrupt the App or associated systems.

 

User Generated Content

You may upload or submit information, photos, notes, or other materials (“User Content”) through the App.

By submitting User Content, you:

  • Retain ownership of your content; and
  • Grant SmartyPlants a worldwide, non-exclusive, royalty-free licence to use, host, reproduce, modify, and display that content for operating, improving, and promoting the Services.

You are responsible for your User Content and must not post anything illegal, defamatory, misleading, or infringing.

We may remove or restrict access to any User Content that breaches these Terms or our policies.

 


 

5. Intellectual Property

 

All content, software, and materials provided through the Services (other than User Content) are owned or licensed by SmartyPlants Ltd.

You are granted a limited, non-transferable licence to use them solely for personal, non-commercial purposes.

 


 

6. Limitation of Liability

 

To the fullest extent permitted by law:

  • SmartyPlants is not liable for indirect or consequential losses, including loss of data, profits, or plants.
  • Our total liability to you shall not exceed the amount you paid for the product.

 

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded under UK law.

 


 

7. Data and Privacy

 

Your personal information is handled in accordance with our Privacy Policy.

By using the App or Services, you consent to our data processing as described in that policy.

 


 

8. Consumer Rights & Dispute Resolution

 

Your Consumer Rights

 

As a UK consumer, you have legal rights under the Consumer Rights Act 2015. These include:

  • Products must be of satisfactory quality, fit for purpose, and as described.
  • You are entitled to a replacement, repair, or refund if a product is faulty.
  • These Terms do not affect your statutory rights.

 

Complaints and Dispute Resolution

 

We aim to resolve all complaints quickly and fairly.

If you have a concern, please contact us at support@smartyplants.ai.

If we cannot resolve your complaint, you may use the Online Dispute Resolution (ODR) platform operated by the European Commission, available at https://ec.europa.eu/consumers/odr/.

Participation in alternative dispute resolution (ADR) is voluntary, and we are not obliged to take part unless required by law.

 


 

9. Governing Law

 

These Terms are governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes.

 


 

10. Changes to These Terms

 

We may update these Terms from time to time.

The latest version will always be available on our website with the “Last updated” date shown above.

Continued use of our Services constitutes acceptance of any updates.
